نتایج نظرسنجی آموزش حقوق بین الملل در دانشکده های حقوق ایران

نتایج نظرسنجی آموزش حقوق بین الملل در دانشکده های حقوق ایران

در اردیبهشت ماه 1391 سه نظر سنجی جداگانه، اما همزمان برای ارزیابی آموزش حقوق بین الملل در ایران، با بهره گیری از امکانات پایگاه اینترنتی www.kwiksurveys.com که از تارنماهای معتبر محسوب میگردد انجام شد. برای دریافت پاسخها، مدت زمان بیست روزه ( دهم اردیبهشت تا یکم خرداد 1391) در نظر گرفته شد. شرکت کنندهها، به ترتیب، عبارتند بودند از 1) 240 تن از دانشجویان دوره کارشناسی حقوق، 2) 142 تن از دانشجویان مقاطع تحصیلات تکمیلی (کارشناسی ارشد و دکتری حقوق بینالملل و حقوق بشر) و 3) 28 تن از اساتید حقوق بینالملل. در انتخاب جامعه آماری سعی شد پراکندگی لازم رعایت گردد. جامعه آماری پرسشنامه شماره یک را دانشجویان کارشناسی حقوق دانشگاههای تهران (پردیس مرکزی)، علامه طباطبایی، شهید بهشتی، بوعلی همدان، کردستان، آزاد اسلامی واحد تهران، آزاد اسلامی واحد خوراسگان، آزاد اسلامی واحد دامغان، آزاد اسلامی واحد بندرعباس، آزاد اسلامی واحد ارومیه، علوم اسلامی رضوی مشهد و مؤسسه آموزش عالی شهید اشرفی اصفهانی تشکیل دادند. جامعه آماری پرسشنامه شماره دو مرکب بود از دانشجویان تحصیلات تکمیلی دانشگاههای تهران (پردیس مرکزی و پردیس بینالمللی کیش)، علامه طباطبایی، شهیدبهشتی، تربیت مدرس، قم، آزاد اسلامی واحدهای تهران، آزاد اسلامی واحد ارومیه، آزاد اسلامی واحد دامغان، آزاد اسلامی واحد بوشهر و پیام نور واحد عسلویه و جامعه آماری پرسشنامه شماره سه متشکل از اساتید دانشگاههای مختلف کشور اعم از دولتی، آزاد و پیام نور بود.

مصونیت در حقوق بین الملل

«انجمن ایرانی مطالعات سازمان ملل متحدبرگزار می کند»

تدوین و توسعۀ تدریجی حقوق بین الملل یکی از وظایفی است که به سازمان ملل متحد واگذار شده است و موضوع مصونیت دولت ها و سازمانهای بین الملی از مهمترین موضوعات حقوق بین الملل است که در سالهای اخیر، به ویژه در اثر آراء صادره از دادگاهای ملی و بین المللی، در مرکز توجه قرار گرفته است. به علاوه، این سازمان به عنوان یک تابع حقوق بین الملل به واسطۀ فعالیت های خود، به ویژه در زمینۀ اداره بین المللی سرزمین ها و عملیات حفظ صلح و برخی برنامه های دیگر، گاه با مسائلی مواجه شده و می شود که مصونیت های سازمان را مطرح می سازد و سؤالها و ابهاماتی را در این خصوص دامن می زند.

از آنجا که رویه های قضایی ملی و بین المللی اخیر و همچنین دکترین نشان دهندۀ وجود اختلاف نظر در خصوص مصونیت دولتها و نمایندگان آنها (اعم از مصونیت های صلاحیتی و اجرایی) و همچنین در مورد مصونیت سازمانهای بین المللی و کارگزارانشان است؛ و نظر به اینکه مسائل بسیاری در مورد مصونیت تابعان حقوق بین الملل (دولتها و نمایندگان آنها و پرسنل دیپلماتیک و کنسولی؛ سازمانهای بین المللی و کارگزارانشان) بدون پاسخ مانده است، انجمن ایرانی مطالعات سازمان ملل متحد تصمیم به برگزاری همایشی با عنوان «مصونیت در حقوق بین الملل» با همکاری خانه اندیشمندان علوم انسانی،کمیته بین المللی صلیب سرخ، کمیته ملی حقوق بشردوستانه و مرکز امور حقوقی بین المللی ریاست جمهوری گرفته است.

محورهای اصلی همایش:

1. مصونیت دولت ها

- مبانی مصونیت دولت ها

- مصونیت نمایندگان دولت ها

- مصونیت کیفری مقامات عالی رتبۀ دولت ها

- مصونیت دولتها در رویۀ قضایی بین المللی

- کنوانسیون 2004 ملل متحد راجع به مصونیت های صلاحیتی دولت ها و اموالشان

- قوانین و آراء محاکم داخلی در زمینۀ مصونیت

2. مصونیت سازمانهای بین المللی

- مبانی مصونیت سازمانهای بین المللی

- مصونیت در موافقتنامه های مقر سازمانهای بین المللی

- مصونیت سازمانهای بین المللی و حق کارگزاران آنها بر دادرسی منصفانه

- مصونیت اعضای نیروهای حافظ صلح

- مصونیت سازمانهای بین المللی در هنگام ادارۀ سرزمین ها

- مصونیت سازمانهای بین المللی در آراء مشورتی دیوان بین المللی دادگستری

- مصونیت سازمانهای بین المللی در تعامل با مسؤولیت آنها

-مصونیت سازمان های بین المللی بشردوستانه

این همایش با موافقت معاونت توسعۀ مدیریت و سرمایه انسانی رئیس جمهور طی نامۀ شمارۀ 83132/91/213/د مورخ 4/6/1391، برگزار می شود.

بدینوسیله از صاحب نظران و پژوهشگران دعوت می شود تا طرح یا چکیدۀ مقاله خود را متناسب با محورهای همایش و با رعایت نکات زیر ارسال فرمایند:

1- طرح یا چکیده مقاله باید در حدود 250 کلمه به صورت تایپ شده در محیط word ، همراه با نام و نام خانوادگی و درجۀ علمی و شغل نویسنده، نشانی پستی و الکترونیکی و تلفن تماس تا تاریخ 5/7/1391 از طریق پست الکترونیکی به دبیرخانه همایش ارسال شود.

2- در صورت تأیید طرح یا چکیدۀ مقاله از نویسندگان درخواست خواهد شد تا متن مقالۀ خود را جهت بررسی نهایی حداکثر تا تاریخ 25/8/1391 از طریق پست الکترونیکی به دبیرخانه همایش ارسال نمایند. تأیید طرح یا چکیده مقاله لزوماً به معنای تایید مقاله نخواهد بود.

3- مقاله ارسالی باید صرفاً برای این همایش نوشته شده و پیش تر در همایش دیگری ارائه نشده یا در هیچ نشریه ای چاپ نشده باشد.

5- مقالات برگزیده اعم از ارائه شده و نشده در همایش به صورت مجموعه مقالات به چاپ خواهند رسید.
