نقش مجمع عمومی سازمان ملل متحد در تدوین و توسعه حقوق بین الملل

مقدمه کتاب :

تدوین و توسعه تدریجی حقوق بین الملل که یکی از مهمترین مأموریت های مجمع عمومی سازمان ملل متحد می باشد نقشی بسیار مهم در تحکیم و پایداری صلح و استقرار حکومت قانون در جامعه بین المللی دارد. بر اساس ماده 13 منشور سازمان ملل متحد مجمع عمومی نسبت به امور زیر موجبات انجام مطالعات و صدور توصیه هایی را فراهم می کند:

الف. ترویج همکاری بین المللی در امور سیاسی و ایجاد زمینه های مناسب برای توسعه تدریجی حقوق بین الملل و تدوین آن، ب...

بر این اساس مجمع عمومی بدون اینکه به قانونگذاری بین المللی مبدل شود با مطالعات پیگیر و کارشناسی دقیق متن قطعنامه ها و یا پیش نویس معاهدات بین المللی را تهیه نموده و برای تصویب در اختیار دولت ها قرار می دهد.

در طول شصت و پنج سالی که از حیات ملل متحد می گذرد مجمع عمومی با اتکا به ارگان های فرعی خویش و به ویژه کمیسیون حقوق بین الملل موفق شده است بخش های مختلف حقوق بین الملل را مدون سازد و در توسعه آن گام بردارد. اینک به یمن مجمع عمومی مجموعه ای گسترده از معاهدات بین المللی حوزه هایی مثل فضای ماورای جو، دریاها و اقیانوس ها، روابط دیپلماتیک و کنسولی، سازمان های بین المللی، مبارزه با تروریسم، حقوق بشر، حقوق بشردوستانه بین المللی، حقوق بین المللی کیفری، حقوق معاهدات، مصونیت قضایی دولت ها و ... را تحت پوشش قرار داده اند. وجود این معاهدات بین المللی به شفاف سازی حقوق بین الملل و کاهش اختلافات بین المللی و یا تسهیل و تسریع اختلافات بین المللی کمک شایان توجهی کرده است.

همایش (نقش مجمع عمومی سازمان ملل متحد در تدوین و توسعه تدریجی حقوق بین الملل) که در شصت و پنجمین سال تأسیس سازمان ملل متحد و شصتمین سالگرد ریاست ایران بر مجمع عمومی، به ابتکار انجمن ایرانی مطالعات سازمان ملل متحد در پنجم و ششم دی ماه 1389 برگزار گردید، حرکت و تلاشی جمعی در ارزیابی کارنامه شصت و پنج ساله مجمع عمومی در وادی مهم تدوین و توسعه تدریجی حقوق بین الملل بوده است.
